| SPAM: Unsolicited Bulk
Email
We do allow our dedicated hosting clients to promoted
their business through the transmission of bulk e-mails,
however, any such mass e-mailings must conform to our
bulk email policies.
Any promotional marketing originating from any of our
networks is strictly prohibited if done through the
transmission of unsolicited bulk email (UBE). In other
words, the bulk emailing must be pursuant to a prior
business relationship with the e-mail recipient, including
but not limited to having obtained their e-mail address
through a verifiable opt-in procedure.
We also strictly prohibit marketing by the transmission
of e-mail that makes use of or contains invalid or forged
headers, invalid or non-existent domain names or other
means of deceptive addressing (counterfeit e-mail).
We also strictly prohibit marketing by the transmission
of e-mail that is relayed from any third party's mail
servers without the permission of that third party,
or which employs similar techniques to hide or obscure
the source of the e-mail. The transmission of unsolicited
bulk e-mail, including the transmission of counterfeit
e-mail, may result in civil and criminal penalties against
the sender under applicable federal and/or state law.
We do NOT authorize the harvesting or collection of
screen names from any ISP service (for example, AOL)
for the purpose of sending unsolicited e-mail.
Facilitating a Violation of this AUP: Advertising,
transmitting, or otherwise making available any software,
program, product, or service that is designed to violate
this AUP or the AUP of any other Internet Service Provider,
which includes, but is not limited to, the facilitation
of the means to spam.
Spamvertising - Intentionally receiving traffic to
a site hosted on our networks that has been generated
by the violation of any of the terms of this AUP is
strictly forbidden. Regardless of where the SPAM was
mailed from, your web site will be terminated here:
without notice & without refund.
HOW TO REPORT UNSOLICITED BULK E-MAIL
(originating from our networks, or regarding sites
hosted on our networks)
Please send your UBE complaint to TotalMatrix Abuse
Departament (abuse@totalmatrix.net)

The best and easiest way to do this is by forwarding
the offending e-mail to abuse@totalmatrix.net
If you cannot forward the UBE, simply send an e-mail
to abuse@totalmatrix.net.
In either case, please include your name, address,
telephone number and any information you may have about
the identity of the person or entity that sent the UBE
to you if possible.
You may be able to collect information about the sender
from the e-mail itself, for instance, by examining the
e-mails header, by examining the webpage or by running
a who-is query against the webpage domain.
Neither our Network Sales Desk or our Customer Support
Center (the numbers below) can process a spam complaint.
Do not attempt to file complaints via telephone. Send
all complaints directly to the Network Security Office
with the email header.
We require that the words "Spam Complaint"
be added to the subject line, to guarantee that the
complaint is forwarded to the abuse desk promptly, and
automatically.
A correct, and working return-email address is required:
if a bogus, or non-working email address is used as
the reply-to or from address, we must assume that the
complaint was frivolous, as there is no way for our
offices to follow up with our investigation: we default
by giving our client the benefit of the doubt.
We can not accept complaints from automated systems.
The complaint must be filed by a human being we can
follow up with if necessary; we do not terminate our
client's accounts based on automated systems that could
inevitably resulted in a erroneous complaint to be filed
against our client.
Each complaint is fully-investigated by a network security
officer on our staff; please make sure that any and
all complaints are forwarded in the correct fashion
so we may properly investigate the complaint. Failure
to supply all the information, will leave us with little
alternative other than the dismissal of the complaint.
Please verify the SPAMVERTISED site is current before
forwarding the complaint. It is entirely possible that
we have received a previous complaint, and already terminated
a SPAMVERTISED site.
You will receive an email at each step of the investigation
process, and be notified upon conclusion of the investigation.
If you wish to participate in the investigation, then
it is obviously necessary to use a real email address.
